Charges

1.1 The monthly tuition fee (“tuition fee”) shall be specified by Elite Black Belt Ltd (“Islington Martial Arts”) from time to time at the relevant school location. Islington Martial Arts shall provide at least one month’s notice by displaying a notice or by informing the student of the proposed changes at the relevant school location.

1.2 The student shall pay Islington Martial Arts the tuition fee, monthly, in advance. The first payment shall be payable on acceptance by Islington Martial Arts of the students’ application and the following monthly payment shall be payable on the agreed day of each month. The minimum period of membership is six months.

1.3 The student may choose to pay the tuition fee for a period of either six or thirty six months by making a one-off payment in advance. See 1.4. In this event, the student is entitled to a discount as specified in the membership details, and the minimum period of membership will be either six or thirty six months respectively. There will be no refund of monies paid within the six or thirty six month period.

1.4 Subject to Clause 1.3, the tuition fee can be paid by the student by cash, cheque or credit/debit card.

1.5 The student shall pay the yearly Martial Arts License and Insurance fee. This fee shall be payable on acceptance by Islington Martial Arts of the students’ application.

1.6 The current yearly Martial Arts License and Insurance fee is £50.00. This fee is non-refundable. Islington Martial Arts shall provide at least one months notice by displaying or informing the student of any proposed changes at the relevant school location.

1.7 The Promotional Test Fee (“Testing Fee”) shall be paid prior to the student taking the Promotional Test. It will become due once the student has been entered for the Promotional Test. Late payment for the Promotional Test will incur an additional £5.00 administration fee.

1.8 The Testing Fee is non-refundable. Islington Martial Arts shall provide at least one months notice by displaying or informing the student of any proposed changes at the relevant school location.

2 Cancellation

2.1 Islington Martial Arts reserves the right at any time, without notice to cancel or suspend the membership of any Student where, in its absolute discretion, there has been or is likely to be a breach of the Students’ terms of membership, or where the Student’s conduct is deemed by Islington Martial Arts (at its sole discretion) to be improper or likely to endanger the welfare, safety or reputation of the relevant Choi Kwang Do school, or where any amounts ~ owed to Islington Martial Arts by the Student have not been paid by their due date.

2.2 Where a Student has not paid their fees by the due date Islington Martial Arts reserves the right to take such action as is appropriate to recover any such outstanding fees.

2.3 Except where the Student has taken advantage of the discount offered in 1.3, the Student may cancel his/her membership on serving not less than one month’s written notice on Islington Martial Arts such notice is not to expire within the first six months of the Student’s membership and subject to the Student having paid all fees up to the date of cancellation.

2.4 The Student may once in any six month period apply to Islington Martial Arts to have his/her membership suspended for a minimum period of one month and a maximum period of twelve months. The application should be in writing and addressed to the Chief Instructor of the relevant school.

Membership

3.1 The types of membership are set out in the membership details. Islington Martial Arts reserves the right to alter the terms of the membership details at any time upon displaying a notice or informing the student of the proposed change(s) at the relevant school location for a reasonable period, up to a maximum of one month. Membership entitles the student to full use of the available facilities at the relevant school during its opening hours subject to compliance with the membership details.

3.2 Each student will be issued with a Student I.D number and Pin number, which will enable the student to access our full website. A Student may not permit his/her I.D number or Pin to be used by anyone else.

3.3 Membership is personal to the student at the relevant school for which membership is granted and cannot be transferred to _ another school which is not operated by Islington Martial Arts. Islington Martial Arts may assign the benefit and burden of this agreement at any time to any person, firm or company without notice to the Member.

3.4 All new students upon acceptance by Islington Martial Arts of the students’ application will be enrolled on the six months Beginners Programme. Once completed, the student will be invited to join the three year Black Belt programme.

3.5 All new students will be offered a discount off the Beginners programme. Students that have completed the six months Beginners programme will be offered a discount off the Black Belt programme provided the student makes a one off payment in advance for his/her tuition.

4 Guests

4.1 All students shall be entitled to introduce guests at the relevant school. An Appointment must be made and confirmed with Islington Martial Arts in advance before the student may bring his/her guest to the relevant school.

5 Conduct

5.1 The student agrees to be bound by the membership details and any damage to the relevant school caused by the student or their guest shall be paid for by the student/parent (guardian).

5.2 The student agrees to notify Islington Martial Arts promptly of any change in his/her address, telephone or payment details.

5.3 Students agree to wear the approved uniform (as supplied by Islington Martial Arts) at all times. Islington Martial Arts has the right to prevent entry into the relevant school by anyone whose behaviour or appearance is deemed by it to be unsuitable

5.4 No alcohol may be brought into the school by students and smoking is strictly forbidden. Students may not enter the school under the influence of alcohol or mind altering drugs.

5.5 Students agree to abide by all rules and guidance displayed throughout the relevant school as well those stated In the Student Guide. Any student not abiding by these rules may be asked to leave and excluded from future membership.

5.6 Where membership is terminated for a breach of Islington Martial Arts membership details, the relevant school rules or failure to follow guidance, there will be no refund of any membership or joining fees.

6 Disclaimer of Liability

6.1 All students who use the relevant school and the facilities do so at their own risk. As far as may be permitted by law Islington Martial Arts Or any associated company or either of its employees or agents shall NOT be liable for:

6.1 The personal injury or death of any student or guest whilst at the relevant school except to the extent that death or personal injury arises from any negligent act or omission of Islington Martial Arts or its employees.

6.1 Any loss, damage or theft of personal property belonging to the student or their guest occurring in the relevant school.

6.2 Students and their guests must consult with their G.P before undergoing any physical activity programme. Students must inform Islington Martial Arts of any medical condition(s) and take appropriate medical advice before using any of its facilities. Students must inform Islington Martial Arts promptly of any change in his/her health.

7 Miscellaneous

7.1. The failure of Islington Martial Arts to enforce any of its rights for any period of time shall not be construed as a waiver of such rights.

7.2 Each of these conditions shall be construed independently. If any provision is held to be invalid, illegal or unenforceable under any law, such provision shall be deemed to be deleted from this agreement and the remainder of the provisions shall remain in full force and effect. In this event, the parties shall negotiate in good faith in order to agree the terms of a mutually acceptable and satisfactory alternative provision in place of the provision so deleted.
